Agency Head Determination. Within 30 Days after the receipt of all materials and information, or such longer time as may be agreed to by the parties, the Agency Head shall make his or her determination and shall deliver or send a copy of such determination to the Contractor and ACCO and, in the case of construction or construction-related services, the City Engineer, City Resident Engineer, City Engineering Audit Officer, or other designee of the Agency Head, together with a statement concerning how the decision may be appealed.

Failure to render a decision within twenty days, or within such longer time as is agreed to by the parties, shall be deemed rejection of the claim for purposes of presenting the claim to the Contract Dispute Resolution Board.
