Agreement Activities. (a) The Land Use Activities specified in item 5 of Schedule 3 are Agreement Activities.
(b) Pursuant to s 32(3)(b) of the Traditional Owner Xxxxxxxxxx Xxx 0000 (Vic), a Land Use Activity specified in item 5 of Schedule 3 must be a Significant Land Use Activity.
(c) The Corporation agrees to respond to a notification made under s 49 of the Traditional Owner Xxxxxxxxxx Xxx 0000 (Xxx) within a period of three months from the date that the notice comes into effect.
Agreement Activities. (a) The grant of an estate in fee simple other than:
(i) A grant made pursuant to s 14 or s 19 of the Traditional Owner Xxxxxxxxxx Xxx 0000 (Vic);
(ii) A grant made for the purpose of a project that is for a public purpose; and
(iii) A grant, transfer or vestment made pursuant to s22A of the Land Xxx 0000.
(b) A Public Land Authorisation (s 27 of the Traditional Owner Settlement Act 2010) that is a:
(i) Commercial Lease for more than 21 years; excluding an authorisation that is associated with a Major Public Works or that is listed in Item 1(a), Item 2(a) or Item 4(d)(iii) of this Schedule.
(c) Major Works and/or clearing of land (s 28 (c) or (e) of the Traditional Owner Settlement Act 2010) for Commercial Purposes (clause 30.1), where a Public Land Authorisation is not required, and excluding Major Public Works.
Agreement Activities. PARTICIPATING DEALER agrees to perform certain Agreement Activities during the Agreement Life.
Agreement Activities. The grant of an estate in fee simple is an Agreement Activity, other than:
(a) a xxxxx made pursuant to s 19 of the Act;
(b) a grant made to facilitate a project that is for a public purpose; or
Agreement Activities. The carrying out of Major Works: for Commercial Purposes; and where a Public Land Authorisation is not required; is an Agreement Activity. This Item specifies the category of Land Use Activities set out in s 28(g), (h) and (la) of the Act, being the: grant of an estate in fee simple; and reservation or revocation of any reservation, in or over land. A change in the status of land that is listed below is an Advisory Activity: the classification of a State Wildlife Reserve under s15(2) of the Wildlife Xxx 0000 (Vic); or the: reservation of land; revocation of the reservation of land; or change in the boundary of a reservation; under the Crown Land (Reserves) Xxx 0000 (Vic).
Agreement Activities. 5.1. To accomplish the purposes of this Agreement, the Parties’ representatives will engage in discussions and use their best efforts to identify activities under which small business firms and educational institutions can make demonstrably productive use of technology-related assistance from NSWC IHEODTD. The Parties will use their best efforts to accomplish the purpose of this Agreement.
5.2. Licensing NSWC IHEODTD Inventions. NSWC IHEODTD will identify to EDD such of its Inventions that are available for licensing. EDD will attempt to locate and identify to NSWC IHEODTD small businesses and educational institutions within its area of responsibility that have an interest in licensing NSWC IHEODTD Inventions. NSWC IHEODTD will engage in discussions with such interested businesses and educational institutions as are identified to it with a view toward reaching a patent license agreement. Such discussions and any resulting license agreement will be accomplished in full accordance with all applicable Federal laws and regulations. EDD may choose to participate in the license discussions and provide such other assistance to interested small businesses or educational institutions as is consistent with its corporate charter.
5.3. Submission of Research Proposals to NSWC IHEODTD. NSWC IHEODTD will identify to EDD areas of NSWC IHEODTD research and development activities where the submission of proposals are desired under the NSWC IHEODTD Broad Agency Announcement (BAA). The NSWC IHEODTD BAA is issued under the provisions of paragraphs 35.016 and 6.102(d)(2) of the Federal Acquisition Regulation (FAR). These provisions provide for the use of BAA’s by agencies to fulfill requirements for scientific study and experimentation directed toward advancing the state-of-the-art or increasing knowledge or understanding rather than focusing on a specific system or hardware solution. EDD will attempt to locate small businesses and educational institutions interested in submitting proposals, advise those interested in proposal requirements, and provide such other assistance as is within its charter to perform. All proposals received will be considered by NSWC IHEODTD in accordance with applicable Federal laws and regulations.
5.4. NSWC IHEODTD Support For Outside Activities. NSWC IHEODTD will identify to EDD research and development capabilities of NSWC IHEODTD that may be made available to small businesses and educational institutions that need or can make use of technology-r...
