Agreement Documents. All data that is used by the City to compute the cost of, or otherwise govern the design and installation of, the Improvements is hereby made a part of this Agreement, and is incorporated herein by this reference as part of Exhibit B.

Agreement Documents. This AGREEMENT, including its attachment and schedule, constitutes the entire AGREEMENT, which supersedes all prior written or oral understandings, and may only be changed by a written amendment executed by both parties. This AGREEMENT may be executed in one or more counterparts and each counterpart shall, for all purposes, be deemed an original, but all such counterparts shall together constitute but one and the same instrument. The following attachment and schedule is hereby made a part of this AGREEMENT: Attachment A - Scope of Services and Billable Fee Schedule These documents make up the AGREEMENT documents and what is called for by one shall be as binding as if called for by all. Notwithstanding the foregoing, in relation to the Software License Agreement (Attachment D) shall be as provided in the respective agreement. This Agreement and the Exhibits set forth above, contain all of the agreements, representations and understandings of the Parties hereto, and supersede and replace any previous understandings, commitments, or agreements, whether oral or written as to those matters contained herein. No prior oral or written understanding shall be of any force or effect with respect to those matters covered hereunder, except as otherwise specifically and expressly authorized in this Agreement. This Agreement may be modified only by a written amendment duly executed by the Parties to this Agreement.
