Common use of Agreement Separable Clause in Contracts

Agreement Separable. If any provision hereof is for any reason unenforceable or inapplicable, the other provisions hereof will remain in full force and effect in the same manner as if such unenforceable or inapplicable provision had never been contained herein. This Agreement will not be binding on the parties unless and until it is approved on behalf of each Fund by action of its Board of Trustees (the “Board”). In that regard PIMCO, in its capacity as investment manager for each Fund, will recommend that the Board approve this Agreement.
