Common use of Aircraft Liability Insurance Clause in Contracts

Aircraft Liability Insurance. If the performance of the Construction Contract requires the use of any aircraft that is owned, leased or chartered by the Companies, aircraft liability insurance insuring the Companies with a $25,000,000 minimum limit per occurrence for property damage and bodily injury, including passengers and crew provided that policy aggregates, if any, shall apply separately to claims occurring with respect to the Project.

If the performance of any of the Construction Contract Project Documents requires the use of any aircraft that is owned, leased or chartered by the CompaniesBorrower, aircraft liability insurance insuring the Companies Borrower with a $25,000,000 minimum limit per occurrence for combined property damage and bodily injury, including passengers and crew provided that policy aggregates, if any, shall apply separately to claims occurring with respect to the Projectcrew.

If the performance of the Construction Contract Agreement requires the use of any aircraft that is owned, leased or chartered by the CompaniesConstruction Agent or any of its contractors or sub-contractors, aircraft liability insurance insuring the Companies Construction Agent (and contractors and sub-contractors if applicable) with a $25,000,000 50,000,000 minimum limit per occurrence for property damage and bodily injury, including passengers and crew provided that policy aggregates, if any, shall apply separately to claims occurring with respect to the ProjectImprovements.

If the performance of the Construction Contract Services requires the use Contractor to provide aircraft (including helicopters), Contractor shall require owners or providers of any aircraft that is owned, leased or chartered by the Companies, aircraft to maintain Aircraft Liability (Bodily Injury (including liability insurance insuring the Companies to passengers) and Property Damage) Insurance with a $25,000,000 minimum combined single limit per occurrence for property damage and bodily injuryof not less than US$25,000,000, including passengers and crew provided that policy aggregates, if any, shall apply separately to claims occurring be met with respect to the Projectany combination of primary or excess coverage.
