Common use of All Other Claims Clause in Contracts

All Other Claims. In the case of all other claims based upon the inaccuracy or breach of a representation or warranty, for a period commencing on the date hereof and ending three years after the Closing Date. No claim for recovery of Indemnifiable Damages arising out of Section 9.1(i) hereof may be asserted by the Indemnitees after the expiration of the applicable time period described in the foregoing Section 9.4(a) and (b); provided, however, that any claim first asserted by the giving of a Notice of Claim within the applicable survival period shall neither be abated nor barred. All Other Claims.
