Common use of ALL PAYMENTS RECEIVED TO BE PAYMENT IN GROSS Clause in Contracts

ALL PAYMENTS RECEIVED TO BE PAYMENT IN GROSS. All monies received by the Chargee from any person or estate capable of being applied in reduction of the Secured Amounts shall be regarded for all purpose as payments in gross and if a receiving order shall be made against any person liable to the Chargee, and if a receiving order shall be made or any effective resolution be passed for the winding-up of any Company liable to the Chargee, the Chargee may prove for the whole of the monies then owing and no money received under such proof shall be considered as having been received and the full amount owing shall be payable until the Chargee has received from all source one hundred cent in the Ringgit Malaysia and if the amount ultimately received by the Chargee exceeds the amount of the ultimate balance owing to the Chargee the excess only over such ultimate balance shall be repaid to the person or party on whose account the same shall have been received by the Chargee.

All monies moneys received by the Chargee Bank from any person or estate capable of being applied in reduction of the Secured Amounts amount due and payable by the Customer to the Bank hereunder and under the Security Documents shall be regarded for all purpose purposes as payments in gross gross, and if a receiving order shall be made against any person liable to the ChargeeBank, and if a receiving or any order shall be made or any effective resolution be passed for the winding-winding up of any Company company liable to the ChargeeBank, the Chargee Bank may prove for the whole of the monies moneys then owing and no money received under such proof shall be considered as having been received received, and the full amount owing shall be payable until the Chargee Bank has received from all source sources one hundred cent sen in the Ringgit Malaysia Malaysia, and if the amount ultimately received by the Chargee Bank exceeds the amount of the ultimate balance owing to the Chargee Bank, the excess only over such ultimate balance shall be repaid to the person or party on whose account the same shall have been received by the ChargeeBank.
