Common use of Alliance dispute process Clause in Contracts

Alliance dispute process. (1) If the PHO wishes to notify a dispute under clause D.8(3), it must do so no later than 20 Business Days after the notice of the proposed variation is given under clause D.8(1)(b). (2) If a dispute is notified by the PHO under clause D.8(3), the dispute will be resolved in accordance with the dispute resolution procedure set out in clause 17 of the Alliance Agreement, as if it were a dispute under that Agreement. (3) If a dispute is notified by the PHO under clause D.8(3)(b), we agree that the variation will not come into effect until our Alliance Leadership Team gives us notice that the dispute has been resolved and confirms the Alliance Recommendation. (1) The PHO will Provide any management services and carry out any management tasks necessary to Provide the Services in accordance with this Agreement.
