Allocat ion. Utility charges are calculated without the use of m eters. The utility bills received by Landlord for the local utility( ies) will be used to calculate the charges per unit. The Landlord’s bill will be allocated to each unit based on one of the following factors, or com bination thereof: square footage of each unit, num ber of Residents in each unit, num ber of bedroom s in each unit, or the num ber of Residents in that unit to calculate the charges for each bedroom . Prior to allocating the Facility’s utility bills using the m ethod described above, we m ay or m ay not deduct an am ount to account for com m on area usage. Landlord and Resident agree that the exact am ount of the utilit ies consum ed in your unit and the exact am ount of utilit ies used in the com m on areas cannot be determ ined precisely, but that the m ethods described above to calculate those am ounts are reasonably accurate estim ates thereof. As a regular part of each utility bill, you m ay be charged and agree to prom ptly pay late paym ent penalties and nonsufficient funds ( NSF)/ chargeback fees directly to the third party billing provider for the Facility in order to cover the adm inistrative costs of generating Resident’s bill and servicing Resident’s account. These fees are in addition the specific utility service charges for which Resident is billed. Landlord and Resident agree that the actual cost to Landlord and/ or billing provider when Resident fails to pay the utility bill on t im e is difficult of im possible to ascertain, but the parties agree that Landlord and/ or billing provider does, in the event of a late paym ent, incur certain costs, such as additional bookkeeping and adm inistrative charges, additional charges from the billing provider, costs in printing and m ailing late notices, lost opportunity costs of the paym ent, etc. Accordingly, Landlord and Resident agree that if the paym ent is received after the enum erated due date, Resident shall im m ediately pay a late paym ent in the am ount set forth below, which is a reasonable estim ate of the costs incurred: Late Paym ent is $10. 00 and NSF/ chargeback penalty is $30. 00 Resident will be charged for the full period of the t im e from the Starting Date of the Lease Contract until it s Ending Date, regardless of whether Resident physically occupies the Prem ises.
