Allocation and Reservation of Capacity. The Water System Extension and Wastewater System E1x7te9n4sion (collectively, the “Extensions”) shall be sized to accommodate the flows specified by1a7n9d5determined pursuant to this Paragraph 7.3. In light of the significant capital investment incu1r7re9d6 by the parties in sizing, designing and constructing the Water System Extension and Wastew1a7te9r7System Extension to accommodate projected increasing flows during the long-term Develop1m7e9n8t of the Property and Community Center Property, the Town shall be obligated to accept the1f7lo9w9 s and flow capacity within such Extensions is hereby reserved by and allocated to County 1a8n0d0 SHS as specified in Paragraphs 7.3.1 and 7.3.3, respectively 1813 1814 1815 1816 1817 1819 1820 1821 1823 1824 1825 1826 1830 1831 1834 1835 (“Extension Flow R1e8s0e1rvations”). SHS may assign portions of the Extension Flow Reservations to any SH18S0-2Successor in SHS’ sole discretion. The Extension Flow Reservations provided for herein sh1a8l0l 3not constitute or result in any reservation of capacity in the Town’s existing water or wa1st8e0w4ater systems. Allocation and reservations of such production or treatment capacities sh1a8ll05remain subject to applicable tariff(s), fees and charges in effect at the time of payment for su1c8h06system capacity, unless otherwise waived by the Town. Nevertheless, the Town agrees that1r8i0g7hts to produce and direct the flows specified in this Paragraph 7.3 through the Extension1s8s0h8all be reserved to and available only for use by County, SHS and/or their assigns. SHS, SH18S0-S9uccessors and County shall not be responsible for any incremental improvements or expan1s8i1o0ns that exceed the flow capacities constructed and reserved pursuant to Paragraphs 7.3.1 or 7.31.831,1if any.
