Common use of Alternative Benefit Clause in Contracts

Alternative Benefit. Notwithstanding the foregoing, if the Corporation terminates the employment of Executive under Section 6 (above) or without Cause under this Section 7 in connection with, or within thirty-six (36) months after, a Change of Control and there is a Separation from Service, then Executive shall be eligible to receive the benefits provided by Section 10(a) but will not receive benefits under Section 7(a).

Alternative Benefit. Notwithstanding the foregoing, if the Corporation terminates the employment of Executive under Section 6 7 (above) or without Cause under this Section 7 in connection with, or within thirty-six (36) months after, after a Change of Control and there is a Separation from Service, then Executive shall be eligible entitled to receive the benefits provided by Section 10(a) 11 but will not be entitled to receive benefits under this Section 7(a)8.

Notwithstanding the foregoing, if the Corporation (or its Successor) terminates the employment of Executive under Section 6 (above) or without Cause under this Section 7 in connection with, or within thirty-six two (362) months years after, a Change of Control and there is a Separation from Service, then Executive shall be eligible to receive the benefits provided by Section 10(a) ), but will he shall not be entitled to receive any benefits under this Section 7(a)7.
