Alternative Mediation or Arbitration Forums. If JAMS is not available to mediate or arbitrate any Dispute as this Section 41 provides, the Disputants will negotiate in good faith with a view to designating an alternative mediation or arbitration forum as soon as practicable, in which case such alternative forum’s rules and procedures will govern the applicable mediation or arbitration proceedings.
