Amendment to Section 6.15 of the Credit Agreement. Section 6.15 of the Credit Agreement is hereby amended and restated in its entirety to read as follows:
Amendment to Section 6.15 of the Credit Agreement. Upon the Fox Merger Effective Date (provided that this Amendment has become effective in accordance with Section 19 hereof), Section 6.15 of the Credit Agreement is hereby amended to add a new clause (c) thereto which shall read in full as follows:
Amendment to Section 6.15 of the Credit Agreement. Section 6.15 of the Credit Agreement, Financial Covenants, is hereby amended by deleting clause (d) thereof in its entirety and substituting the following in lieu thereof:
Amendment to Section 6.15 of the Credit Agreement. Section 6.15 of the Credit Agreement is amended by adding the following sentence at the end thereof: For purposes of this Section 6.15, display rack costs shall be treated as Capital Expenditures when incurred, regardless of whether such costs are accounted for as Capital Expenditures.
Amendment to Section 6.15 of the Credit Agreement. Effective as of the Amendment Date, clause (a) of Section 6.15 of the Credit Agreement is amended and restated in its entirety to read “(a) the Obligated Parties may enter into Contingent Obligations with respect to Indebtedness permitted pursuant to Section 6.14”.
