Amendment to Section 7.01(a). Section 7.01(a) (Quarterly Reports) of the Credit Agreement is amended by inserting the following new sentence at the end of such Section: In addition to the foregoing, as long as any obligations remain outstanding under the Canadian Guaranty, Holdings shall use its commercially reasonable efforts to furnish or cause to be furnished to the Administrative Agent as soon as available and in any event within 45 days after the end of each of the first three fiscal quarters of each year, a copy of the consolidated financial statements of Xxxxxxx Truck Centre Limited and its subsidiaries (including balance sheet and statement of income and retained earnings) for such fiscal quarter, prepared in accordance with generally accepted accounting principles in Canada, as in effect from time to time.
Amendment to Section 7.01(a). Section 7.01(a)(i) of the Financing Agreement is hereby amended by deleting the reference to “45 days” therefrom and inserting in place thereof a reference to “40 days.”
