Common use of Ancillary Rights Clause in Contracts

Ancillary Rights. 3.1 The Landlord grants the Tenant the following rights (the Rights): (a) the right to support for the Equipment from those parts of the structure of the Building to which the Equipment is attached or on which it rests (in each case with permission given under or in accordance with this lease); (b) the right [between the hours of [TIME] and [TIME] on [weekdays/weekends]] [at all times] to use those Common Parts as are shown hatched red on Plan [2] for the purposes of [vehicular and] pedestrian access between the Property and the public highway known as [INSERT NAME OF ADJACENT PUBLIC HIGHWAY] [and for access to the washrooms referred to in clause 3.1(c)] [and to access and read the meters which monitor the electricity generated by the Equipment or exported to the Grid]; (c) [the right [between the hours of [TIME] and [TIME] on [weekdays/weekends]] to use the washrooms shown hatched green on Plan [2];] (d) the right, provided the Tenant complies with clause 3.9, to: (i) install in the Common Parts such electricity cables and ancillary equipment as are required in order to transmit electricity to and from the Equipment, either as part of the electrical supply within the Building or in order to export to the Grid electricity generated by the Equipment; (ii) access those cables and ancillary equipment (on reasonable prior notice to the Landlord, save in the case of emergency) in order to inspect, repair and maintain them; (e) [the right, provided the Tenant complies with clause 3.9, to use and to connect into any Service Media at the Building that satisfy all of the following tests: (i) they belong to the Landlord; (ii) they relate to the transmission of electricity within the Building; and (iii) they are in existence at the date of this lease or are installed or constructed during the period of [INSERT AGREED PERIOD] years from commencement of the Contractual Term;] (f) the right, provided the Tenant complies with clause 3.9, to attach the Equipment to or rest the Equipment on that part of the roof of the Building as lies immediately below the Property; [and] (g) [the right (subject to payment in accordance with clause 10.1) to the supply of electricity to the Property;] [and] (h) [ANY OTHER SPECIFIC RIGHTS THAT NEED TO BE GRANTED]. 3.2 The Rights granted in clause 3.1(b), clause 3.1(c) and clause 3.1(e) are granted in common with the Landlord and any other person authorised by the Landlord. 3.3 The Rights are granted subject to the Third Party Rights insofar as the Third Party Rights affect the Common Parts and the Tenant shall not do anything that may interfere with any Third Party Right. 3.4 The Tenant shall exercise the Rights only in connection with its use of the Property for the Permitted Use. 3.5 The Tenant shall exercise the Rights in accordance with any regulations made by the Landlord as mentioned in clause 27. 3.6 The Tenant shall comply with all laws relating to its use of the Common Parts pursuant to the Rights. 3.7 The Landlord may, at its discretion, change the route of any means of access to or egress from the Property through the Common Parts so long as a means of access and egress is maintained at all times, save in case of emergency. 3.8 In relation to the Right mentioned in clause 3.1(e), the Landlord may, at its discretion, re-route or replace any such Service Media and that Right shall then apply in relation to the Service Media as re-routed or replaced. 3.9 In relation to the Rights mentioned in clause 3.1(d), clause 3.1(e) and clause 3.1(f) the Tenant may only exercise those Rights: (a) if the Landlord has first granted consent for the works; and (b) in accordance with the terms of that consent. 3.10 Except as mentioned in this clause 3, neither the grant of this lease nor anything in it confers any right over the Common Parts or any other part of the Building or any neighbouring property and section 62 of the Law of Property Act 1925 does not apply to this lease.

(c) [the [non-exclusive/exclusive] right [between to park [ ] private cars or motorbikes belonging to the hours of [TIME] Tenant, its employees and [TIMEvisitors within the area hatched [ ] on [weekdays/weekends]] to use the washrooms shown hatched green on Plan [2];] (d) the right, provided the Tenant complies with clause 3.9, to: (i) install in right to use any such areas of the Common Parts such electricity cables and ancillary equipment as are required in order designated by the Landlord from time to transmit electricity to and from the Equipment, either as part of the electrical supply within the Building or in order to export time for keeping bicycles belonging to the Grid electricity generated by the Equipment; (ii) access those cables Tenant, its employees and ancillary equipment (on reasonable prior notice to the Landlord, save in the case of emergency) in order to inspect, repair and maintain themvisitors; (e) the right to use any such areas of the Common Parts as designated by the Landlord from time to time for loading and unloading goods and materials; (f) [the rightright to use the waste disposal and recycling areas (if any) on the Common Parts for the disposal and storage of refuse and recycling;] (g) the right to use any clinical waste areas (if any) in the Building; (h) the right to use any Lifts, provided and the Tenant complies with hallways, corridors, stairways and landings of the Common Parts for the purposes of access to and egress from the Property and the lavatories and washrooms referred to in clause 3.9, 3.1(i) (if any) [and the Shared Areas referred to in clause 3.1(k)]; (i) the right to use the lavatories and washrooms (if any) in the Shared Areas of the Building (if any); (j) [the right to shared use of reception on the [ ] floor of the Building;] (k) [the right to use the Shared Areas;] (l) the right to use and to connect into any Service Media at the Building that satisfy all of the following tests: (i) they belong to the LandlordLandlord and serve (but do not form part of) the Property; (iim) they relate the right to display the name and logo of the Tenant (and any authorised undertenant) and information relating to the transmission hours of electricity within operating and services offered from the Property on a sign or noticeboard in such locations as designated by the Landlord from time to time, and in a font and style that is consistent with those prevailing at the Building; and (iii) they are in existence at the date of this lease or are installed or constructed during the period of [INSERT AGREED PERIOD] years from commencement of the Contractual Term;] (fn) the right, provided right to enter the Tenant complies with clause 3.9, Common Parts or any other Lettable Unit so far as is reasonably necessary to attach the Equipment to or rest the Equipment on that part of the roof of the Building as lies immediately below the Property;
