AND WHEREAS DMRC and the Concessionaire have agreed to appoint Bank (the Escrow Agent) and the said bank has agreed to act as the Escrow Agent to hold and administer monies deposited in the Escrow Account and to transfer such monies in accordance with the terms of this Agreement read with the Concession Agreement.
