Common use of and Witness Clause in Contracts

and Witness. If an employee is required to serve as a juror in any court of law, or is required to attend as a witness in a court proceeding in which the Crown is a party, or is required by subpoena to attend a court of law or coroner's inquest in connection with a case arising from the employee's duties at the Hospital, the employee shall not lose regular pay because of such attendance provided that the employee: notifies the Hospital immediately on the employee's notification that he will be required to attend at court; presents proof of service requiring the employee's attendance; deposits with the Hospital the full amount of compensation received excluding mileage, travelling and meal allowances and an official receipt thereof. In addition to the foregoing, where an employee is required by subpoena to attend a court of law or coroner's inquest in connection with a case arising from the employee's duties at the Hospital on a day on which he has not been scheduled to work, he shall be paid for all hours actually spent at such hearing at his regular straight time hourly rate subject to the overtime provisions of the collective agreement and subject to and above. Where the employee's attendance is required during a different shift than is scheduled to work that day, the Hospital will attempt to reschedule the shift to include the time spent at such hearing. It is understood that any rescheduling shall not result in the payment of any premium payment. Where the Hospital is unable to reschedule the employee and, as a result, is required to attend during other than regularly scheduled paid hours, shall be paid for all hours actually spent at such hearing at the straight time hourly rate subject to (a), and above.

Where the employee's attendance is required during a different shift than is scheduled to work that dayvacation, the Hospital will attempt to reschedule the shift to include the time spent at such hearing. It is employee's regular day off or vacation period, it being understood that any rescheduling shall not result in the payment of any premium paymentpay. Where If the Hospital is unable fails to reschedule such employees, the Hospital shall arrange lieu time off work for all days the employees would otherwise be off work had it not been for the attendance at Court or the Coroner's Inquest. (Applicable to part-time employees) In addition to the foregoing, where a part-time employee and, as a result, is required by subpoena to attend during other than a court of law or Coroner's inquest, in connection with a case arising from the employee's duties at the Hospital, on his regularly scheduled paid hoursday off, he shall receive regular pay as if he had been scheduled to work the day. (The following clauses related to Pregnancy Leave and Parental Leave will be paid for incorporated in all hours actually spent at such hearing at the straight time hourly rate subject to (a), and above.collective agreements:)
