Subpoenaed Witness. For each day that the employee is compensated by the Crown, the employee shall be compensated by the Employer at $50.00 per day and by the Union at $50.00 per day up to a maximum of 4 calendar weeks or 20 working days. Proof of payment by the Crown shall be presented to the Employer and to the Union.

Subpoenaed Witness. An employee subpoenaed in cases involving the School District or students (e.g., a parent custody case) served within the School District, will be permitted time off without the loss of pay and will be allowed to retain any allowable expenses reimbursed by the court. An employee subpoenaed in cases unrelated to the School District, will be permitted time off and use of paid or unpaid leave will be at the discretion of the Superintendent. Any allowable expenses reimbursed by the court, such as mileage, parking, and meals, may be retained and are the sole responsibility of the employee to seek through the court. The District shall assume no responsibility to seek reimbursement, nor pay reimbursement for said expenses.

Subpoenaed Witness i) The Board shall grant paid leave to employees, other than employees on leave without pay, who serve as subpoenaed witnesses in a court action, provided such court action is not occasioned by the employee’s private affairs.
Subpoenaed Witness. Teachers absent from duty as a result of serving as a subpoenaed witness shall be paid the difference between compensation received for each day of required court appearance and regular earnings. To be eligible, the teacher must immediately notify the building principal of any notice to serve as a subpoenaed witness and follow this up with proper application for business absence days as outlined in Item 14.7 of this article. The administration reserves the right to request that the teacher be excused from serving as a subpoenaed witness. These conditions of payment shall apply only during those days when school is in session during the regular school year when the teacher is scheduled to report for duty. There shall be no absence days charged against the teacher's accumulation provided all conditions set forth in this item have been met.
Subpoenaed Witness. An employee subpoenaed to appear as a witness before any court, or administrative, executive or legislative tribunal, which is vested by law with powers of subpoena and territorial jurisdiction in this State, a sister State or the United States, shall be released from duty, with applicable straight time pay for the duration necessary to comply with the subpoena. Time off work shall be verified for pay purposes by providing the Department Director with a copy of the subpoena and documentation from the court of court attendance.
