Annual Notices. BOSTON FINANCIAL shall, during each year this Agreement is in effect, provide Plan Sponsors a copy of the most recent version of IRS Form 5304 SIMPLE. In anticipation of such mailing, the Trust agrees to notify BOSTON FINANCIAL each time the IRS revises IRS Form 5304-SIMPLE. In addition, BOSTON FINANCIAL agrees to mail a SIMPLE ▇▇▇ Employee Participation Notice with a cover letter, both to be written by the Trust, to Participants.
Annual Notices. Within seven (7) days of the commencement of each Lease Year (defined below) Tenant shall disclose to Landlord the names and approximate amounts of all Hazardous Materials which Tenant intends to use, place, store, handle, or dispose of in, on, under, from, above, or about the Leased Premises in the coming Lease Year. In addition, within seven (7) days of the commencement of each Lease Year (beginning with the second Lease Year), Tenant shall disclose to Landlord the names and amounts of all Hazardous Materials that to Tenant’s knowledge were actually used, placed, stored, handled, or disposed of in, on, under, from, above, or about the Leased Premises, if such materials were not previously identified to Landlord at the commencement of the previous Lease Year. The term “Lease Year” as used in this Lease shall mean any twelve (12) month period beginning with the Commencement Date and each twelve (12) month period beginning on any anniversary date thereof.
