Annual Performance Hearing. 3068 A. Objectives. Agency or SBWMA may hold a public performance hearing in April or 3069 May of each Rate Year, at which time Contractor shall be present and shall 3070 participate by making a presentation and responding to questions. Agency or 3071 SBWMA shall convene the hearing to address the positive and negative aspects of 3072 Contractor’s overall performance. The purpose of the hearing may also involve 3073 discussion and review of technological, economic, and regulatory changes in 3074 Collection, waste reduction, Recycling, processing, and Disposal practices that can 3075 improve quality of service; increase waste reduction and diversion; and ensure 3076 services are being provided effectively and economically. Topics for discussion and 3077 review at the performance hearing shall include, but not be limited to: Contractor’s 3078 accomplishments and compliance with various provisions of the Agreement, 3079 services provided, feasibility of providing new services, application of new 3080 technologies, Customer Complaints, possible amendments to this Agreement, 3081 developments in the Applicable Laws and regulations, new initiatives for meeting or 3082 exceeding waste reduction and Recycling goals, regulatory constraints, and 3083 Contractor performance. Agency or SBWMA and Contractor may each select 3084 additional topics for discussion at the performance hearing. 3085 B. Process. Within sixty (60) Days of notification provided by Agency or SBWMA to 3086 Contractor of its intent to conduct a performance hearing, Agency or SBWMA will 3087 submit questions to Contractor pertaining to Contractor’s performance and 3088 Contractor shall submit its written response within thirty (30) Days. Agency or 3089 SBWMA and Contractor shall meet to discuss the questions and Contractor’s 3090 response prior to submittal by Contractor. Agency or SBWMA and Contractor may 3091 request from one another information or documents related to the scheduled public 3092 hearing and Agency or SBWMA and Contractor shall provide such information 3093 promptly. 3094 In addition to Contractor’s responses to the questions submitted by Agency or 3095 SBWMA, Contractor may be required to submit a self-assessment report of 3096 Contractor’s performance and information pertaining to the following: 3097 1.
