Annual Quantity. An amount equal to 182,500,000 MMBtus per contract year, as adjusted pursuant to the contract terms.
Annual Quantity. An annual contract quantity equal to approximately forty-five million six hundred thousand (45,600,000) MMBTU per full calendar year, subject to the terms and conditions of the Agreement.
Annual Quantity. “Annual Quantity” shall mean the quantity of water that is made available by CADIZ each year during the term of this Agreement through its intended water and groundwater management program that will optimize conservation, maximize reasonable and beneficial use, and avoid loss of groundwater to evaporation, and is more specifically defined in Section 3.4 hereof.
Annual Quantity. Subject to the terms and conditions hereof, including Section 2.04, the quantity of Concentrates which the Seller shall deliver and sell to the Buyer, and the Buyer shall receive and purchase from the Seller, in each Contract Year shall be equal to the Base Amount for that Contract Year, determined pursuant to Section 2.02.
Annual Quantity. The annual contract quantity is equal to fifty-two million (52,000,000) MMBtu, or approximately one million (1,000,000) metric tonnes per annum.
Annual Quantity. In this Agreement for purposes of calculating the volume of product in a calendar year or any other period specified in this Agreement, references to “Products shipped and delivered” or “Products purchased” shall include Products ordered in conformity with the provisions of this Agreement for delivery within that calendar year, whether or not delivered, unless non-delivery is a result of the actions of Client. * Redacted text has been omitted and filed separtely pursuant to a request for confidential treatment.
Annual Quantity. The Client acknowledges that the fee for Manufacturing in respect of a Product in any Year is quoted based upon the Annual Volume and Minimum Order Quantity per Product specified in Schedule B (if applicable) and is subject to change following good faith discussions by the parties if the specified Annual Volume or Minimum Order Quantity (if and as applicable) increases or decreases. For greater certainty, if Patheon and the Client agree that the Annual Volume or Minimum Order Quantity (if and as applicable) in respect of a Product shall be reduced beyond the range of such values provided in the tables in Schedule B, and, as a result of such reduction, Patheon’s costs for services relating to such Product increase on a per unit basis, then Patheon shall be entitled to an increase in the fee for Manufacturing in respect of such Product. In addition, for greater certainty, if Patheon and the Client agree that the Annual Volume or Minimum Order Quantity (if and as applicable) in respect of a Product shall be increased beyond the range of such values provided in the tables in Schedule B, and, as a result of such increase, Patheon’s costs for services relating to such Product decrease on a per unit basis, then the Client shall be entitled to a decrease in the fee for Manufacturing in respect of such Product.
