Annual Statement of Operating Results - Underpayment and Overpayment of Rents. If the Annual Statement of Operating Results described above indicates that the Rents for the Contract Year have been underpaid then, subject to City’s acceptance and approval of such certification, the amount of such underpayment shall be refunded by the Concessionaire Tenant to the City within thirty (30) days after receipt of the Annual Statement unless the Agreement Term has expired, in which event the Concessionaire Tenant shall promptly pay such amounts to the City. If the certification indicates that the Rents for the Contract Year have been overpaid, then subject to City acceptance and approval of such certification, the amount of such overpayment shall be deducted from amounts due and owing to the Concessionaire Tenant,
