Common use of Anti-Terrorism Regulations Clause in Contracts

Anti-Terrorism Regulations. 49.1 In accordance to the Terrorism Act 2000 and all subsequent regulations pursuant to this Act, the Supplier will assure itself to the best of its knowledge that UK funding, including financial assets or economic resources is not made available, either directly or indirectly to, or for the benefit of persons, groups or entities listed in accordance with European Council Regulation EC/2580/2001 (as amended) and/or the Terrorism (United Nations Measures) Orders 2009 of the United Kingdom, or contravene the provisions of those and any subsequent applicable terrorism legislation. 49.2 The Supplier represents and warrants that neither it, nor to the best of its knowledge any Supplier Personnel, servants, agents or Sub‐Contractors, or any person acting on their behalf, have at any time prior to the Commencement Date and/or during the term of this Contract appeared on the Home Office Proscribed Terrorist Organisations List. 49.3 The Supplier shall immediately notify DFID in writing if it becomes aware of any breach of Clause 49.1 and/or Clause 49.2, or has reason to believe that it has or any Supplier Personnel, servants, agents or Sub‐Contractors, or any person acting on their behalves have: 49.3.1 been subject to an investigation or prosecution which relates to an alleged infringement of Clause 49.1 and/or Clause 49.2; 49.3.2 been listed by any government department or agency as being debarred, suspended, proposed for suspension or debarment, or otherwise ineligible for participation in government procurement programmes or contracts. 49.4 Where the Supplier or any of his employees, servants, agents or Sub‐Contractors, or any person acting on their behalf, breaches any of the acts mentioned in Clause 49.1 and/or Clause 49.2 commits any offence under the Terrorism Act 2000, with or without the knowledge of the Supplier, in relation to this Contract or any other contract with the Crown, DFID shall be entitled: 49.4.1 to terminate the Contract with immediate effect by written notice to the Supplier and recover from the Supplier the amount of any loss resulting from the termination; 49.4.2 to recover from the Supplier any other loss sustained as a result of any breach of this Clause 49, whether or not the Contract has been terminated.

Anti-Terrorism Regulations. 49.1 36.1 In accordance to the Terrorism Act 2000 Xxx 0000 and all subsequent regulations pursuant to this Act, the Supplier Subcontractor will assure itself to the best of its knowledge that UK fundingany payment received under, or relating to this Agreement, including financial assets or economic resources is not made available, either directly or indirectly to, or for the benefit of persons, groups or entities listed in accordance with European Council Regulation EC/2580/2001 (as amended) and/or the Terrorism (United Nations Measures) Orders 2009 of the United Kingdom, or contravene the provisions of those and any subsequent applicable terrorism legislation. 49.2 36.2 The Supplier Subcontractor represents and warrants that neither it, nor to the best of its knowledge any Supplier Subcontractor Personnel, servants, agents or Sub‐Contractorssubcontractors, or any person acting on their behalf, have at any time prior to the Commencement Effective Date and/or during the term of this Contract Term appeared on the Home Office Proscribed Terrorist Organisations List. 49.3 36.3 The Supplier Subcontractor shall immediately notify DFID Sightsavers in writing if it becomes aware of any breach of Clause 49.1 36.1 and/or Clause 49.236.2, or has reason to believe that it has or any Supplier Subcontractor Personnel, servants, agents or Sub‐Contractorssubcontractors, or any person acting on their behalves have: 49.3.1 36.3.1 been subject to an investigation or prosecution which relates to an alleged infringement of Clause 49.1 36.1 and/or Clause 49.236.2; 49.3.2 36.3.2 been listed by any government department or agency as being debarred, suspended, proposed for suspension or debarment, or otherwise ineligible for participation in government procurement programmes or contracts. 49.4 36.4 Where the Supplier Subcontractor or any of his employees, servants, agents or Sub‐Contractorssubcontractors, or any person acting on their behalf, breaches any of the acts mentioned in Clause 49.1 36.1 and/or Clause 49.2 36.2 commits any offence under the Terrorism Act 2000Xxx 0000, with or without the knowledge of the SupplierSubcontractor, in relation to this Contract Agreement or any other contract with the Crown, DFID Sightsavers shall be entitled: 49.4.1 36.4.1 to terminate the Contract Agreement with immediate effect by written notice to the Supplier Subcontractor and recover from the Supplier Subcontractor the amount of any loss resulting from the termination; 49.4.2 36.4.2 to recover from the Supplier Subcontractor any other loss sustained as a result of any breach of this Clause 4936, whether or not the Contract Agreement has been terminated.
