DUŠEVNÍ VLASTNICTVÍ 10.1 INSTITUTION and INVESTIGATOR agree and acknowledge that SPONSOR owns all rights in and to the STUDY PRODUCT and any and all clinical data generated from the STUDY. INSTITUTION and INVESTIGATOR agree to disclose promptly to SPONSOR or its nominee any and all inventions, discoveries and improvements conceived or made by INVESTIGATOR and/or other STUDY PERSONNEL relating to the STUDY PRODUCT which arise during the STUDY, and agree to assign their respective interests therein to SPONSOR or its nominee. 10.1 ZDRAVOTNICKÉ ZAŘÍZENÍ a ZKOUŠEJÍCÍ souhlasí a berou na vědomí, že ZADAVATELI patří všechna práva na HODNOCENÝ PŘÍPRAVEK a na veškeré klinické údaje generované z této STUDIE. ZDRAVOTNICKÉ ZAŘÍZENÍ a ZKOUŠEJÍCÍ souhlasí s tím, že zpřístupní ZADAVATELI, nebo jím určené osobě, veškeré vynálezy, objevy a zlepšení vymyšlené nebo vytvořené ZKOUŠEJÍCÍM a/nebo dalším PERSONÁLEM STUDIE, které se vztahují na HODNOCENÝ PŘÍPRAVEK a které vznikly během STUDIE, a souhlasí s postoupením jejich náležitých zájmů ZADAVATELI nebo jím určené osobě.

WSIB & LTD An Employee who is receiving benefits under the Workplace Safety and Insurance Act, or under an LTD plan, is not entitled to benefits under a school board’s sick leave and short-term disability plan for the same condition unless the employee is on a graduated return to work program then WSIB/LTD remains the first payor. For clarity, where an employee is receiving partial benefits under WSIB/LTD, they may be entitled to receive benefits under the sick leave plan, subject to the circumstances of the specific situation. During the interim period from the date of the injury/incident or illness to the date of the approval by the WSIB/LTD of the claim, the employee may access sick leave and short-term leave and disability coverage. A reconciliation of sick leave deductions made and payments provided, will be undertaken by the school board once the WSIB/LTD has adjudicated and approved the claim. In the event that the WSIB/LTD does not approve the claim, the school board shall deal with the absence consistent with the terms of the sick leave and short-term leave and disability plans.

Rozhodné právo This Agreement shall be interpreted and enforced under the laws of Czech Republic. All disputes arising out of this Agreement will be resolved by the court of the Czech Republic of competent jurisdiction. Tato Smlouva bude vykládána a vymáhána v souladu s právním řádem České republiky. Veškeré spory z této Smlouvy budou řešeny před příslušnými soudy České republiky.
