Common use of Appeal of Breach Clause in Contracts

Appeal of Breach. CONTRACTOR may request a hearing regarding the alleged breach by filing a written request with the AGENCY Board of Directors. Such request shall be filed not more than fifteen (15) calendar days after notice of the breach. If such request is received, the AGENCY shall set the matter for public hearing on a date not more than sixty (60) calendar days following receipt of such written request, and shall give CONTRACTOR at least fifteen (15) calendar days written notice of the time, date and place of the hearing. AGENCY shall issue its written decision and findings within thirty (30) calendar days after the date of the close of the hearing.
