As provided in Section 24.1 of Appendix 2 to this ISA and subject to the requirements thereof, Interconnection Customer represents that it meets all qualifications and requirements as set forth in Section 118(a) and 118(b) of the Internal Revenue Code of 1986, as amended and interpreted by Notice 2016-36, 2016-25 I.R.B. (6/20/2016) (the “IRS Notice”). Interconnection Customer agrees to conform with all requirements of the safe harbor provisions specified in the IRS Notice, as they may be amended, as required to confer non-taxable status on some or all of the transfer of property, including money, by Interconnection Customer to Interconnected Transmission Owner with respect to the payment of the Costs of construction and installation of the Transmission Owner Interconnection Facilities specified in this ISA. Nothing in Interconnection Customer’s agreement pursuant to this Schedule G shall change Interconnection Customer’s indemnification obligations under Section 24.2 of Appendix 2 to this ISA.

Nothing in Interconnection Customer’s agreement pursuant to this Schedule G shall change Interconnection Customer’s indemnification obligations under Section 24.2 of Appendix 2 to this ISA, Interconnection Customer shall pay Interconnected Transmission Owner a monthly charge as determined below (the “Monthly Charge”) related to the Attachment Facilities that are owned by the Interconnected Transmission Owner (“TO Attachment Facilities”). The Monthly Charge shall commence on the first of the month following the in-service date of TO Attachment Facilities and shall be determined as shown below. Line 1 of this calculation shall be updated as described below. Lines 2, 3, and 4 of this calculation shall initially be based on the most recently filed annual true-up to the Interconnected Transmission Owner’s populated rate formula, which formula is set forth in the PJM Tariff, Attachment H-14B, AEP East Companies (hereinafter “East OpCo”), as applicable or its successor. The same lines will be updated based on the formula rate’s annual true-up submitted to FERC. The updates will be made effective the first day of the month after 45 days has passed since the date of the true-up submission. For any additions, removals, modifications, or replacements of the TO Attachment Facilities, Interconnection Customer shall pay to Interconnected Transmission Owner the capital cost of any such additions, removals, modifications or replacements of the TO Attachment Facilities as contributions-in-aid-of-construction, plus any applicable taxes. The “Cost of TO Attachment Facilities” used to determine the Monthly Charge shall be updated annually, to reflect any such changes; the update to Line 1, if any, will be effective the same date as the updates to Lines 2, 3, and 4. The revisions described above shall determine an updated value for Line 6 of the Monthly Charge calculation. Any revisions to lines 1, 2, 3, and 4 of this calculation made in accordance with this Schedule E shall not require filing with the Commission. The cost of TO Attachment Facilities and the Monthly Charge shall be rounded to the nearest dollar.
