Common use of Application and Approval Clause in Contracts

Application and Approval. (i) An Employee shall make written application to her/his Employer on or before January 31st of the year prior to the year in which the deferment is to commence, requesting permission to participate in the Plan. (ii) Notwithstanding 52.3(a)1, an Employer may waive the deadline of January 31st under special circumstances. (b) Written acceptance, or denial, of the Employee’s request, with explanation, shall be forwarded to the Employee by April 1st in the year the original request is made. (c) Approval of individual requests to participate in the Plan shall rest solely with the Employer. Subject to operational requirements, approval shall not be unreasonably denied. (d) All Employees wishing to participate in the Plan shall be required to sign a contract before final approval for participation shall be granted.
