Application and Interpretation Instruments. 1. For purposes of this Chapter: a) the tariff classification of goods shall be based on the Harmonized System; and b) the principles and rules of the Customs Valuation Agreement shall be used to determine the value of a good or a material. 2. For purposes of this Chapter, the Customs Valuation Agreement will be applied to determine the origin of a good as follows: a) the principles and rules of the Customs Valuation Agreement shall be applied to domestic transactions, with the modifications required by the circumstances, as they would apply to international transactions; and b) the provisions of this Chapter shall prevail over those of the Customs Valuation Agreement, where there are inconsistencies.
