Application of Differentials Clause Samples

The 'Application of Differentials' clause defines how differences in rates, prices, or other contractual values are calculated and applied between parties. In practice, this clause specifies the method for determining the differential—such as comparing a contract price to a market reference price—and outlines when and how these adjustments are made, for example, in commodity sales or financial settlements. Its core function is to ensure that any fluctuations or discrepancies are handled transparently and fairly, thereby allocating risk and providing a clear mechanism for adjusting payments or obligations.
Application of Differentials. If a worker has been receiving a shift differential or some other differential or pay for work-out- of-class as provided in this MOU or in the Salary Ordinance for 30 or more calendar days immediately preceding a paid holiday, or the commencement of a vacation or the commencement of a paid sick leave period, or compensatory time off, as the case may be, the applicable differential shall be included in such worker's holiday pay, vacation pay, paid sick leave or paid compensatory time. The vacation, sick leave, holiday and compensatory time off pay of a worker on a rotating shift shall include the shift differential such worker would have received had he/she been working during such period.
Application of Differentials. If a worker has been receiving a differential or pay for work-out-of-class as provided in this MOU or in the Court Personnel Rules for 30 or more calendar days immediately preceding a paid holiday, or the commencement of a vacation or the commencement of a paid sick leave period, or compensatory time off, as the case may be, the applicable differential shall be included in such worker's holiday pay, vacation pay, paid sick leave or paid compensatory time.
Application of Differentials. If an employee has been receiving pay for work out of class as provided in this MOU or in the Salary Ordinance for thirty (30) or more calendar days immediately preceding a paid holiday, the commencement of a vacation, the commencement of a paid sick leave period, or compensatory time off, as the case may be, the work out of class pay shall be included in such employee's holiday pay, vacation pay, paid sick leave or paid compensatory time.
Application of Differentials. The differentials provided in this Section 10 shall not be a part of the basic salary or considered in computation of a maximum salary of any employee.
