Appointment of Class Representatives. Plaintiffs (“Named Plaintiffs”) are 17 18 designated and appointed as the Settlement Class Representatives pursuant to Rule 23(a) of the 19 Federal Rules of Civil Procedure. The Court preliminarily finds, for settlement purposes only, 20 that Named Plaintiffs will fairly and adequately represent the interests of the Class in enforcing 21 their rights in the Action; that Named Plaintiffs are similarly situated to absent Settlement Class 22 Members; that Named Plaintiffs have Article III standing to pursue their claims; and that Named Plaintiffs are therefore typical of the Class and will be adequate class representatives.
