Common use of Appointment of Independent Engineer Clause in Contracts

Appointment of Independent Engineer. The Authority shall appoint a consulting engineering firm from a panel of 10 (ten) firms or bodies corporate, constituted by the Authority substantially in accordance with the selection criteria set forth in Schedule-P, to be the independent consultant under this Agreement (the "Independent Engineer"). The appointment shall be made no later than 90 (ninety) days from the date of this Agreement and shall continue until two years from COD of Commercial Complex. After the completion of tenure of Independent Engineer all correspondences, permissions, submissions or any dispute(s) arising out of O&M obligations of Concessionaire as mentioned in this Concession Agreement shall be brought to the Maintenance Committee. The decision of the Maintenance Committee in this behalf shall be made in accordance with the provisions of Concession Agreement. For the additional work(s) in Bus Terminal in accordance with Article 16, the Authority shall appoint a consulting engineering firm, to be the consultant under this Agreement (the "Additional Engineer"). Notwithstanding anything to the contrary contained in this Article, the Authority may in its discretion appoint a government-owned entity as the Additional Engineer; provided that such entity shall be a body corporate having as one of its primary function the provision of consulting, advisory and supervisory services for engineering projects.
