Reports of unusual occurrence. The Contractor shall, during the Maintenance Period, prior to the close of each day, send to the Authority and the Authority’s Engineer, by facsimile or e- mail, a report stating accidents and unusual occurrences on the Project Highway relating to the safety and security of the Users and Project Highway. A monthly summary of such reports shall also be sent within 3 (three) business days of the closing of month. For the purposes of this Clause 15.4, accidents and unusual occurrences on the Project Highway shall include:
(a) accident, death or severe injury to any person;
(b) damaged or dislodged fixed equipment;
(c) flooding of Project Highway; and
(d) any other unusual occurrence.
Reports of unusual occurrence. The Concessionaire shall, prior to the close of each day, send to the Authority and the Independent Engineer, by facsimile or e-mail, a report stating accidents and unusual occurrences on the Bus Terminal relating to the safety and security of the Users, Bus Terminal and passengers. A weekly and monthly summary of such reports shall also be sent within three days of the closing of each week and month, as the case may be. For the purposes of this Clause 19.6, accidents and unusual occurrences on the Bus Terminal shall include:
(a) death or injury to any person;
(b) damaged or dislodged fixed equipment;
(c) any obstruction on the Bus Terminal, which results in slow down of the services being provided by the Concessionaire;
(d) disablement of any equipment during operation;
(e) communication failure affecting the operation of Bus Terminal;
(f) smoke or fire;
(g) flooding of Bus Terminal; and
(h) such other relevant information as may be required by the Authority or the Independent Engineer.

(c) Any damage or obstruction on the Project, which results in slow down of the services being provided by the Concessionaire;

(e) Communication failure affecting the operation of the Project;
(f) Smoke or fire;
(g) Flooding of the Project; and
(h) Such other relevant information as may be required by the Authority or the Independent Engineer.

Reports of unusual occurrence. The Concessionaire shall, upon occurrence of accidents or unusual occurrences on the Rail System, send to MOR, by facsimile or e-mail, a report, in a mutually agreed form, stating accidents and unusual occurrences on the Rail System relating to the safety and security of the Users and the Rail System, as soon as reasonably practicable, and in any event no later than 24 (twenty four) hours after such occurrence. A weekly and monthly summary of such reports shall also be sent within 3 (three) days of the closing of each week and month, as the case may be. For the purposes of this Clause 20.2, accidents and unusual occurrences on the Rail System shall include:
(a) death or injury to any person;
(b) broken or buckled rails;
(c) damaged or dislodged fixed equipment;
(d) damage to or displacement of traction power conductor; or loss of traction power;
(e) any obstruction on the track;
(f) signalling and communication failure affecting the running of trains;
(g) any obstruction or undue congestion in the provision of Reserved Services;
(h) smoke or fire;
(i) flooding of tracks;
(j) any other event rendering the Rail System unsafe and/or unusable for providing the Reserved Services by MOR; and
(k) such other relevant information as may be reasonably required by MOR or the Independent Engineer.
Reports of unusual occurrence. On the first day of each week, the Concessionaire shall, send to the Authority and the Monitoring Agency, by facsimile or e-mail, a report in a pre-agreed format, stating all accidents and unusual occurrences on the Hospital relating to the safety and security of the Patients, visitors and staff and the Hospital in the preceding week. A monthly summary of such reports shall also be sent within 3 (three) days of the closing of each month. For the purposes of this Clause 19.2, accidents and unusual occurrences in the Hospital shall include:
(a) death or injury to any person on account of any accident occurring within the Hospital premises including but not limited to a fire in the Hospital premises;
(b) episode of sexual assault or rape;
(c) suicide by a Patient;
(d) unanticipated death of a full-term infant;
(e) infant abduction or discharge to the wrong family;
(f) haemolytic transfusion reaction involving administration of blood or blood products having major blood group incompatibilities;
(g) surgery on the wrong Patient or wrong body part;
(h) smoke or fire;
(i) unintended retention of a foreign object in the body of any Patient after surgery or other procedure; and
(j) such other relevant information as may be reasonably required by the Authority or the Monitoring Agency.
Reports of unusual occurrence. The Affected Party shall give notice to the other Party of any event of Force Majeure as soon as reasonably practicable, but not later than seven (7) days after the date on which such Party knew or should reasonably have known of the commencement of the event of Force Majeure. If an event of Force Majeure results in a breakdown of communications rendering it unreasonable to give notice within the applicable time limit specified herein, then the Party claiming Force Majeure shall give such notice as soon as reasonably practicable after reinstatement of communications, but not later than one (1) day after such reinstatement. Provided that such notice shall be a pre-condition to the Affected Party’s entitlement to claim relief under this Agreement. Such notice shall include full particulars of the event of Force Majeure, its effects on the Party claiming relief and the remedial measures proposed. The Affected Party shall give the other Party regular (and not less than monthly) reports on the progress of those remedial measures and such other information as the other Party may reasonably request about the Force Majeure Event. The Mine Operator shall, prior to the close of each day, send to the Authority and the Independent Engineer, by facsimile or e-mail, a report stating accidents and unusual occurrences, if any, at the Mines relating to the safety and security of the Mines and persons affected by it. A weekly and monthly summary of such reports shall also be sent within 3 (three) days of the closing of each week and month, as the case may be. For the purposes of this Clause 19.2, accidents and unusual occurrences at the Mines shall include:
(a) death or injury to any person;
(b) any damage or obstruction at the Site;
(c) disablement of any element of the Mines during operation thereof;
(d) flooding of the Mines;
(e) smoke or fire; or
(f) such other relevant information as may be reasonably required by the Authority or the Independent Engineer. Any occurrence as mentioned under Regulation 9 of the Coal Mine Regulations, 1957 shall be reported immediately as required.
