Common use of Apportionment of Costs After Withdrawal Clause in Contracts

Apportionment of Costs After Withdrawal. Any future installment or portion thereof, of any principal and interest on debt obligations outstanding on the effective date of withdrawal of a Member Town, which obligations were incurred by the Partnership as a local service cost attributable to such withdrawing Member Town, shall continue to be assessed to such withdrawing Member Town until the outstanding debt obligations are satisfied or appropriately transferred to an authorized successor. Due dates of payment shall be as specified in Section 15. The withdrawing Member Town’s maximum annual share of operating costs shall be paid based on the most recent fiscal year’s share of operating costs over the subsequent three year period with payments declining by one-third each year unless another town or customer purchases the capacity of the withdrawing Member Town. Due dates of payment shall be as specified in Section 15.
