Approval of Application. Upon approval of the Application by the County, the County will countersign the Application and deliver the same to the Applicant to indicate the County’s approval. The Applicant must then enter into a standard form County Dark Fiber License Agreement with the County. The County will use commercially reasonable efforts to issue a Notice of Availability to the Applicant within ninety (90) days after the standard form County Dark Fiber License Agreement has been fully executed by the Applicant. If the County does not issue a Notice of Availability within ninety (90) days after receipt of a fully executed standard form County Dark Fiber License Agreement from the Applicant, the Applicant may withdraw its Application.
