APPROVAL OF MUNICIPAL SERVICES AND WORKS. i. Upon the completion of the balance of the municipal services and works required in accordance with this Agreement and prior to the expiration of the (1) year maintenance period, the Owner shall make a written request to the Town for a final inspection. Such request shall be accompanied by a certificate from the Owner’s Engineer verifying that the services and works have been constructed in accordance with the approved plans and specifications, together with the final record drawings required under Section 8.b.i.(5) of this Agreement, and a certificate from an Ontario Land Surveyor as required under Section 9.h. The Town shall make such inspection within two (2) weeks of the Town receiving such request and the Owner shall repair any deficiencies listed by the Town as soon as it is practical thereafter and upon all repairs being completed, and if the Owner has complied with all other terms of this Agreement, the Town shall grant final approval of such services and works, and thereupon the ownership of such services shall vest in the Town and thereafter the Town shall bear the costs of all expenses therewith. Where required to carry out the intent of this paragraph, the Owner shall deliver conveyances and transfers at no expense to the Town in a form acceptable to the Town’s solicitor.
