Approval of Request and Retroactive Charges. 18.3.1 If AT&T-22STATE approves Attaching Party’s Application for a new or amended Occupancy permit, Attaching Party shall be liable to AT&T-22STATE for all fees and charges associated with the unauthorized attachments as specified in the Pricing Schedule to this Agreement. The issuance of a new or amended occupancy permit as provided by this article shall not operate retroactively or constitute a waiver by AT&T- 22STATE of any of its rights or privileges under this Appendix or otherwise.
