Approvals of Materials and Equipment. 4.24.1. Local Laws - All materials, appliances and types or methods of construction shall be in accordance with the Specifications, and shall in no event be less than that necessary to conform to the requirements of the Administrative Code and the Charter of the City of New York. 4.24.2. Approval of Manufacturer - The names of proposed manufacturers, materialmen, and dealers who are to furnish materials, fixtures, equipment, appliances and other fittings shall be submitted to the EIU for approval within two (2) weeks after Contract award date to afford NYCDOT time to conduct a proper investigation. Any such approval shall not relieve the Contractor of any of its responsibilities under the Contract. 4.24.3. No manufacturer will be approved for any materials to be furnished under the Contract unless it has successfully produced similar products. 4.24.4. All transactions with the manufacturers, materialmen, or subcontractors or others providing work or equipment for this Contract shall be through the Contractor unless the Contractor requests, in writing, to the Commissioner, that the manufacturer, materialmen, subcontractor or other deal directly with representatives from NYCDOT and NYCDOT agrees to do so in writing. Any such transaction shall not in any way release the Contractor from its responsibilities under the Contract. 4.24.5. All materials, fixtures, fittings, supplies and equipment furnished under the Contract shall be new and unused, of standard first grade quality and of the best workmanship and design. 4.24.6. Luminaires and/or photoelectric controls furnished by the Contractor shall be in accordance with the latest Specifications and drawings for the particular item. The Contractor shall obtain all guarantees and warranties from manufacturer(s), in the name of the City of New York, and shall deliver same to the City. All technical data and samples shall be approved by the EIU before the Contractor proceeds with the purchase of these items.
