Common use of Arbitration of Disputes; Expenses Clause in Contracts

Arbitration of Disputes; Expenses. The parties agree that all disputes that may arise between them relating to the interpretation or performance of this Agreement, including matters relating to any funding arrangements for the benefits provided under this Agreement, shall be determined by binding arbitration through an arbitrator approved by the American Arbitration Association or other arbitrator mutually acceptable to the parties. The award of the arbitrators shall be final and binding upon the parties and judgment may be entered in any court having jurisdiction. Each party shall pay its own legal fees and other expenses associated with the arbitration, provided that the fee for the arbitrator shall be shared equally.
