Common use of Arbitration or Litigation Clause in Contracts

Arbitration or Litigation. (a) If the parties fail to settle any Dispute in accordance with clause 19.2, the parties may agree to submit the Dispute for resolution to final and binding arbitration under the Rules of Arbitration of the Institute of Arbitrators and Mediators Australia by one or more arbitrators appointed in accordance with those rules. (b) If the parties do not agree to refer the dispute to arbitration in accordance with clause 19.3(a), either party may submit the dispute for resolution to the non exclusive jurisdiction of the Courts of Victoria, Australia.
