Common use of Arrangements with Mortgagee Clause in Contracts

Arrangements with Mortgagee. (a) The Developer agrees with the Council that if the Developer mortgages the Land after this agreement is entered into it must use all reasonable efforts at that time to arrange a multiple party deed of agreement between the Council, the Developer, and the mortgagee who will be providing finance for the Works so that the mortgagee accepts that the responsibilities set out in this agreement are binding upon the mortgagee in the event that the Developer defaults on the mortgage and the mortgagee takes possession of the Land.

Arrangements with Mortgagee. (a) The Developer agrees Parties agree with the Council that if the Developer mortgages Parties mortgage the Land after this agreement is entered into it they must use all reasonable efforts at that time to arrange a multiple party deed of agreement between the Council, the DeveloperDeveloper Parties, and the mortgagee who will be providing finance for the Works so that the mortgagee accepts that the responsibilities set out in this agreement are binding upon the mortgagee in the event that the Developer defaults Parties default on the mortgage and the mortgagee takes possession of the Land.

(a) The Developer and Landowner agrees with the Council that if the Developer or Landowner mortgages the Land after this agreement is entered into it must use all reasonable efforts at that time to arrange a multiple party deed of agreement between the Council, the Developer, and the mortgagee who will be providing finance for the Works so that the mortgagee accepts that the responsibilities set out in this agreement are binding upon the mortgagee in the event that the Developer defaults on the mortgage and the mortgagee takes possession of the Land.
