It is mutually agreed that where negotiations are conducted on a joint basis between any or all of the nursing homes in the chain in the Province of Ontario, to which the Union will elect or select Employer is a negotiating committee consisting of one (I)representative from each nursing home. If negotiations are carried on individually for any or all of the Nursing Homes in the chain in the Province of Ontarioparty, it is agreed that the Union will elect or otherwise select a negotiating committee consisting of three (3) employees, one (I)of which shall be the Chief Xxxxxxx1) representative from each nursing home. All members of the committee shall be regular employees of the Employer who have completed their probationary period. The nursing home members of the Committee This representative will be paid by the Employer for time used during normally scheduled working hours in negotiation negotiations of this Agreement or its successor including all conciliation proceedings proceeding but excluding any Arbitration arbitration proceedings. The Employer will recognize a acknowledges the right of the Union Administrative Committee for both the full-time and part-time bargaining units, which shall consist of a Chief Xxxxxxx and four to appoint or otherwise select three (43) stewards, at one (1) of which shall be a member of the part-time bargaining unit. Not more than It is agreed that any two (2) committee members shall meet with Management at one time. The Employer shall be advised of the names Union Representatives of members of this committee and shall Local .ON may be notified of present with the Union Committee at their request at any changes from time to time. All members of the committee referred to above shall be regular employees of the Employer who have completed their probationary periodUnion-Management meeting. The Union acknowledges that the members Stewards and Union Committee Members have regular duties which must be performed on behalf of the Union Administrative Committee must continue to perform Nursing Home and that such employees will not leave their regular duties, duties without first obtaining permissionto do so from the Administrator or his designate. Such permissionshall not be unreasonably withheld. The Union and that the Employer will use their best efforts to schedule meetings in such a manner so far as possible all activities to minimize disruptions to the normal operations of the committee will be carried on outside the regular working hours of the members thereof, unless otherwise mutually arrangednursing home. The Employer shall pay representatives and Committee members their respective respective: wages for all time lost from regularly scheduled hours investigating and/or processing grievances, up to but not including the arbitration stage, negotiation of the Collective Agreement and renewals thereof, up to and including conciliation, and while attending meetings with the Employer. Employees on the evening and night shift shall receive paid time off for the actual day of the negotiating meeting.. It is agreed that there will be no deduction from the pay of Stewards or Committee Members for time spent on the premises of the Nursing Home while meeting with representatives of the Employer during an employee's scheduled working hours for which permission has been granted by the Administrator or his designate. ARTICLE UNION REPRESENTATION AND COMMITTEES. If negotiations are carried on individually for any or all of the Nursing Homes in the chain in the Province of Ontario, it is agreed that the Union will may elect or otherwise select a negotiating committee Negotiating Committee consisting of three two (32) employees, employees one (I)of of which shall may be the Chief Xxxxxxx. All members of the committee Committee shall be regular employees of the Employer who have completed their probationary period. The nursing home Employer will pay wages lost by two (2) members of the Bargaining Committee will be paid by the Employer for time used during normally scheduled working hours spent in negotiation negotiations of this Agreement or its successor during hours which they would normally have been scheduled to work. This shall also apply to negotiations for the renewal of this Agreement including all conciliation proceedings Conciliation but excluding any Arbitration proceedingsArbitration. The Employer will recognize a Union Administrative Committee for both the full-time and part-time bargaining units, which shall consist of a Chief Xxxxxxx and four three (43) stewards, at stewards (one (1) of which shall be a member from each of the part-time nursing, housekeeping and dietary) all selected from the members of the bargaining unit. Not , not more than two (2) committee of which Committee members shall meet with Management at any one time. The Employer shall not be required to recognize such stewards until advised in writing of the names of the members of this committee and shall be notified of any Committee including changes from time to time. All members of the committee referred to above Committee shall be regular full time employees of the Employer who have completed their probationary period. The Union acknowledges that the members of the Union Administrative Committee must continue to perform their regular duties, and that so far as possible all activities of the committee will be carried on outside the regular working hours of the members thereof, unless otherwise mutually arranged. The Employer shall pay representatives and Committee members their respective wages for all time lost from regularly scheduled hours investigating and/or processing grievances, up to but not including the arbitration stage, negotiation of the Collective Agreement CollectiveAgreement and renewals thereof, up to and including conciliation, and while attending meetings with the Employer. Employees on the evening and night shift shall receive paid time off for the actual day of the negotiating meeting. Where there are matters of mutual concern and interest that would be beneficial if discussed at a Committee meeting during the term of this Agreement, the following will apply. An equal number of representatives of each party as mutually agreed shall meet at a time and place mutually satisfactory. A request for such meeting will be made in writing at least one (1) week prior to the date proposed and accompanied by an agenda of matters proposed to be discussed, which shall not include matters that are properly the subject of a grievance or matters that are properly the subject of negotiations for the amendment or renewal of this Agreement. Suitable subjects for discussion will include orientation, aggressive residents and workload issues. A representative attending such a meeting shall be paid for wages lost from regularly scheduled hours. A Union staff member may attend as a representative of the Union. Meeting will be held quarterly unless otherwise agreed. It is understood that where full and part time agreements are separate, there shall be one (1) committee only. Recognizing the mutual objective of quality care, the Employer agrees to meet the Labour Committee with the Union as soon as after the receipt of the annual (as amended) results. The Employer agrees to provide the Union Representatives with staffing levels, and staffing mix information; the impact of related payroll costs on staffing levels and a written notice of the (as amended) results for the facility. The purpose of this meeting is to discuss the impact of the (as amended) changes on the staffing levels in the facility, and quality care, and provide the Union with an opportunity to make representation in that regard. The parties shall meet as necessary to discuss other changes or workload issues. The parties may invite additional participants to attend the meeting to support constructive review and discussion. It is agreed that the Union and the employees will not engage in Union activities during working hours or hold meetings at any time on the premises of the Employer without the permission of the Administrator. When such permission is granted and such union business is completed the employee will advise the administrator or her designate.
