Artistic Control. Company and Artist shall be jointly responsible for all decisions regarding the artistic content of the Recording.
Artistic Control. Artist shall have artistic control over the Performance; provided however, that Artist shall not engage in any obscene behavior, nor shall Artist encourage or entice the audience to engage in violent, destructive or riotous behavior. FSU shall have the right to direct Artist to discontinue any activity constituting the aforementioned behavior and behavior that violates FSU policy, as well as any federal, state, or local law.
Artistic Control. Artistic control of ARTIST'S performance SHALL BE SOLELY vested in ARTIST with regard to material, accompaniment, wardrobe, lighting, sound and staging, etc.
Artistic Control. ARTIST shall have the sole and exclusive control over the production, presentation and performance of the engagement hereunder; including but not limited to, the means and methods of the performance. PURCHASER agrees that no performers other than those to be furnished by ARTIST or approved by ARTIST will appear in connection with the engagement which is the subject of this Agreement. PURCHASER will not authorize Artist’s performance hereunder to be recorded or broadcast in any manner whatsoever without written permission from ARTIST.
Artistic Control. Sponsor will impose no artistic judgments on the Project or in any way attempt to determine the content of the project, unless the Sponsor determines that Project Content would be in violation of exempt purposes.
Artistic Control. Artist shall have artistic control over the performance and artist’s personnel. Vanderbilt, however, shall have the right to direct Artist to discontinue any activity constituting violation of Vanderbilt policy, as well as any federal, state, or local law. Independent Contractor. The parties are independent contractors and neither is an employee of the other. Each party shall be responsible for, and hold the other harmless from, any injuries caused by it or suffered by its personnel during the performance of this agreement, including injuries which may be compensable under any workers’ compensation laws. No assignment. Neither party may assign this Agreement without the written consent of the other.
Artistic Control. The Artist shall have artistic control over the creation of the Edition. Solely the Artist shall make all artistic decisions.
Artistic Control. Except as otherwise stated herein, Artist shall have the sole and exclusive control over the production, presentation and performance of the engagement hereunder, including, but not limited to, the means and methods of the performances of the performing personnel. Artist acknowledges that this engagement is at a family-oriented event and shall consider this in its production, presentation, and performance.
Artistic Control. It is agreed that LDA will have total artistic control over all WBC productions directed by LDA, including, but not limited to, control over casting, selection of productions, and composition of LDA staffing; it being understood however, that LDA shall operate within the financial budget established by WBC for each production.
Artistic Control. Xxxxxxxxxx will have exclusive control of the artistic content of the performance and the personnel who may be performing in Tallymoore for the contracted performance(s) hereunder. Tallymoore may, in its sole discretion, substitute a competent replacement for any member of the Tallymoore band who is unable to perform at the engagement, or elect not to do so. Indemnity: The Purchaser indemnifies Tallymoore LLC and its associated personnel against all claims by Xxxxxxxxx and Purchaser’s employees, agents, contractors, patrons, licensees or any other person who, as a result of the performance/s or cancellation of performance/s, suffers any loss or damage. Dispute Resolution: The parties agree that the courts of the State of Wisconsin have exclusive jurisdiction to determine disputes in relation to this Agreement. No party will institute legal proceedings unless reasonable steps are first taken to settle any dispute by negotiation. Each party is liable for its own costs in the event of a dispute, except that where Xxxxxxxxxx is successful in pursuing or defending a dispute then the Purchaser will pay Tallymoore’s costs on an indemnity basis. The validity, construction and performance of this Rider and the contract to which it is appended will be governed by the laws of the State of Wisconsin. Video and Audio Taping: For concert or theatre venue engagements: Purchaser shall not, and shall exercise all reasonable efforts not permit any person in attendance at the performance to record, broadcast or digitally stream, in any manner whatsoever, Xxxxxxxxxx’s performance without express written consent from Tallymoore. Tallymoore and/or its designees shall have the right to record the performance and to use the recordings as Xxxxxxxxxx sees fit. Purchaser shall have no interest or rights of any kind in or to any such recordings of Xxxxxxxxxx’s performance during the contracted engagement.
