Common use of As-Built Supplement; Modifications to Facility Clause in Contracts

As-Built Supplement; Modifications to Facility. No later than ninety (90) days following the Commercial Operation Date, Seller must provide Utility the As-Built Supplement which will be incorporated into Exhibits B and C of this Agreement and if applicable, an updated statement of Expected Net Output that will be incorporated in Exhibit A of this Agreement. Except with Utility’s prior written consent or as permitted under and subject to the requirements of Section 6.7, the Facility, as reflected in the As-Built Supplement to be provided under this Section or subsequently during the Term, may not (a) have a Nameplate Capacity Rating that exceeds that stated in Exhibit B, or (b) results in the Expected Net Output, as shown in Exhibit A, as of the Effective Date, increasing by more than ten percent (10%), except to the extent Seller complies with the requirements of Section 6.7.3.
