Assignment and Subrogation of Rights Against Third Parties. In the event of good-faith and bona fide claims on behalf of Developer related to Releases of Hazardous Materials by a third party who is not a Developer-Related Entity, the Department agrees that, upon receipt of a written request from Developer, the Department in its reasonable discretion will assign and subrogate its rights of recovery to Developer, as such may exist.
