Common use of Assignment of Subrents Clause in Contracts

Assignment of Subrents. Tenant hereby assigns and transfers to Landlord all of Tenant's interest in any rentals or other income arising from any sublease heretofore or hereafter made by Tenant. Landlord may collect such rentals and income and apply same toward Tenant's obligations under this Lease; provided, however, that until an Event of Default shall have occurred, Tenant shall be entitled to receive, collect, and enjoy such rentals and income, subject to the provisions of Subsection 13.5 above. Landlord shall not, by reason of this or any other assignment of any sublease to Landlord, nor by reason of any collection of rentals from a subtenant, be deemed liable to such subtenant for any failure of Tenant to perform or comply with any of Tenant's obligations to such subtenant under its sublease. Tenant hereby irrevocably authorizes and directs any such subtenant, upon receipt of a written notice from Landlord stating that an Event of Default has occurred under this Lease, to pay to Landlord the rentals due and to become due under the sublease. Assignment of Subrents. To secure Xxxxxx's performance hereunder, Xxxxxx hereby assigns, transfers, and sets over to Landlord, subject to the conditions in this paragraph, Xxxxxx's right, title, and interest in and to all Subleases and Subrent. Tenant hereby assigns grants to Landlord, and transfers its agents and representatives, a right to enter, and sufficient possession of, the Premises to permit and assure Xxxxxxxx's collection of Subrent. Xxxxxxxx's exercise of such rights shall not constitute an eviction of Tenant. Unless and until this Lease has terminated, Tenant shall have a license to exercise its right, title, and interest in and to all Subleases and Subrent including, without limitation, any security deposits required thereunder. Landlord may revoke such license, at its option, if and only if this Lease has terminated. Upon any such revocation, Landlord may collect Subrent directly from Subtenants, and apply the net amount collected to the Rent and Tenant shall immediately assign to Landlord all security deposits then held by Tenant pursuant to any such Subleases.
