Common use of ATS Clause in Contracts

ATS. If the termination for cause occurs after a Change in Control, the Company shall not have the right to suspend or withhold payments to Executive under any provision of this Agreement until or unless a final judgment is entered upholding the Company's determination that the termination was for cause, in which event Executive will be liable to the Company for all amounts paid, plus interest at the rate allowed for judgments under Article 5069-1.
