Common use of Auction cancellation Clause in Contracts

Auction cancellation. 1. In case the Allocation Platform cancels an Auction, all Bids already submitted and any results of the respective Auction shall be deemed null and void. 2. The Allocation Platform shall partially cancel an Auction if not all Bidding Zone borders contained in the Auction are affected by the incidents as listed in paragraph 5 below. The partial cancellation will be applied on all Bids submitted for an Affected Bidding Zone Border. For the avoidance of doubt, for the non-affected Bidding Zone border(s) all Bids submitted for this Bidding Zone border(s) shall be processed by the Allocation Platform and respective results shall be notified to Registered Participants via the Auction Tool according to Articles 33 and 34. 3. Paragraph 2 of this Article shall only be effective as of the due date publically communicated by the Allocation Platform in the information for the application of paragraph 2, but earliest on the thirtieth (30th) calendar day after the publication of this information. In addition to this publication the Allocation Platform shall send a notice according to Article 62 to Registered Participants containing the same information. 4. The Allocation Platform shall inform all Registered Participants without undue delay, of the Auction cancellation / partial Auction cancellation by notification published in the Auction Tool or on website of Allocation Platform and by electronic means as specified by the Allocation Platform on its website. 5. An Auction cancellation / partial Auction cancellation shall be announced in the following cases: (a) before the Auction results publication in case the Allocation Platform faces technical obstacles during the Auction process like a failure of standard processes and fallback procedures or similar reasons; and (b) after the Auction results publication, in the event of erroneous results due to incorrect Marginal Price calculation or incorrect allocation of Daily Transmission Rights to Registered Participants or similar reasons. 6. In case of Auction cancellation / partial Auction cancellation before the Auction results publication, no compensation shall be paid to the Registered Participants. 7. The Allocation Platform shall publish on its website, without undue delay, the reasons for the Auction cancellation / partial Auction cancellation. 8. Stipulations of this Article can be applied to Fallback Auctions in the event of erroneous results CHAPTER 7‌ Article 44‌ 1. Daily Transmission Rights may be curtailed in the event of Force Majeure and emergency situation 2. Curtailment may be applied on allocated Daily Transmission Rights including, where the case may be, on nominated Physical Transmission Rights. 3. Daily Transmission Rights shall not be curtailed after the Day Ahead Firmness Deadline except in the case of Force Majeure or emergency situation in accordance with Article 72 of Commission Regulation (EU) 1222/2015. For the avoidance of doubt, Daily Transmission Rights when curtailed after the Day Ahead Firmness Deadlines shall be curtailed in the same way as long term capacity and compensated in accordance with legislation. 4. Each Registered Participant affected by curtailment shall lose its right to nominate for physical use the concerned Physical Transmission Rights if such right exists in the moment of curtailment. 5. In case of curtailment, the affected Registered Participant is entitled to receive reimbursement or compensation according to Articles 47 to 49.
