Common use of Australian Customers Clause in Contracts

Australian Customers. This Section 10.3 applies only if the Customer is located in Australia. Nothing in this Agreement excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term of condition, implied or imposed by any legislation that cannot lawfully be excluded or limited, including under the Competition and Consumer 2010 (Cth) (“Australian Non-Excludable Provision”). To the maximum extent permitted by law, Oxford’s entire liability for breach of an Australian Non-Excludable Provision in relation to this Agreement or the Customer’s use of the Goods is limited to (at Oxford’s option):
