Common use of Authority of Developer Clause in Contracts

Authority of Developer. Xxxxxxxxx has full power and authority to execute and deliver this Agreement and to make and accept the borrowings contemplated hereunder, to execute and deliver the Loan Documents and all other documents or instruments executed and delivered, or to be executed and delivered, pursuant to this Agreement, to Develop and operate the Property, and to perform and observe the terms and provisions of all of the above.

Authority of Developer. Xxxxxxxxx Developer has full power and authority to execute and deliver this Agreement and to make and accept the borrowings contemplated hereunder, to execute and deliver the Loan Documents Authority Promissory Note and Authority Deed of Trust for the Authority Subordinate Loan, the Regulatory Agreement, Ground Lease, Memorandum of Ground Lease, Notice of Affordability Restrictions, Request for Notice and all other documents or instruments executed and delivered, or to be executed and delivered, pursuant to this Agreement, to Develop and operate the Property, and to perform and observe the terms and provisions of all of the above.

Xxxxxxxxx Developer has full power and authority to execute and deliver this Agreement and to make and accept the borrowings contemplated hereunder, to execute and deliver the Loan Documents Authority Promissory Note and Authority Deed of Trust for the Authority Subordinate Loan, the Regulatory Agreement, Ground Lease, Memorandum of Ground Lease, Memorandum of Agreement, Notice of Affordability Restrictions, Request for Notice and all other documents or instruments executed and delivered, or to be executed and delivered, pursuant to this Agreement, to Develop and operate the Property, and to perform and observe the terms and provisions of all of the above.

Authority of Developer. Xxxxxxxxx Developer has full power and authority to execute and deliver this Agreement and to make and accept the borrowings contemplated hereunder, to execute and deliver the Loan Documents City Restrictions, Promissory Note, Deed of Trust, Regulatory Agreement, Option Agreement, Memorandum of Agreement, Request for Notice, UCC-1 Financing Statement and all other documents or instruments executed and delivered, or to be executed and delivered, pursuant to this Agreement, to Develop and operate the Property, and to perform and observe the terms and provisions of all of the above.
