Common use of Authority to act on behalf of Concessionaire Clause in Contracts

Authority to act on behalf of Concessionaire. 25.6.1 During the period of Suspension, the Authority shall, on behalf of the Concessionaire, collect all Project Revenues under and in accordance with this Agreement and deposit the same in the Escrow Account. The Authority shall be entitled to make withdrawals from the Escrow Account for meeting the O&M Expenses and for meeting the costs incurred by it for remedying and rectifying the cause of Suspension. 25.6.2 During the period of Suspension hereunder, all rights and liabilities vested in the Concessionaire in accordance with the provisions of this Agreement shall continue to vest in the Concessionaire, and all things done or actions taken, including expenditure incurred by the Authority for discharging the obligations of the Concessionaire under and in accordance with this Agreement and the Project Agreements, shall be deemed to have been done or taken for and on behalf of the Concessionaire and the Concessionaire undertakes to indemnify the Authority for all costs incurred during such period. The Concessionaire hereby leases, licenses and sub-leases, sub-licenses respectively, the Authority or any other person authorised by it, to use during Suspension, all Intellectual Property belonging to or licensed to the Concessionaire with respect to the Project and its design, engineering, construction, operation and maintenance and which is used or created by the Concessionaire in performing its obligations under the Agreement.

During the period of Suspension, the Authority shall, on behalf of the Concessionaire, collect all Project Revenues User Charges and revenues under and in accordance with this Agreement and deposit the same in the Escrow AccountAgreement. The Authority shall be entitled to make withdrawals from recover the Escrow Account for meeting the O&M Expenses and amount for meeting the costs incurred by it for remedying and rectifying the cause of Suspension, and thereafter for defraying the expenses that may be specified elsewhere in this Agreement. 25.6.2 25.2.2. During the period of Suspension hereunder, all rights assets and liabilities vested in the Concessionaire in accordance with the provisions of this Agreement shall continue to vest in the Concessionaire, therein and all things done or actions taken, including expenditure incurred by the Authority for discharging the obligations of the Concessionaire under and in accordance with this Agreement and the Project Agreements, shall be deemed to have been done or taken for and on behalf of the Concessionaire and the Concessionaire undertakes to indemnify the Authority for all costs incurred during such period. The Concessionaire hereby leases, licenses and sub-leases, sub-licenses respectively, the Authority or any other person authorised authorized by it, it under Clause 25.1 to use during Suspension, all Intellectual Property belonging to or licensed to the Concessionaire with respect to the Project and its design, engineering, construction, operation and maintenance maintenance, and which is used or created by the Concessionaire in performing its obligations under the Agreement.

During the period of Suspension hereunder, all rights and liabilities vested in the Concessionaire in accordance with the provisions of this Agreement shall continue to vest in the Concessionaire, therein and all things done or actions taken, including expenditure incurred by the Authority for discharging the obligations of the Concessionaire under and in accordance with this Agreement and the Project Agreements, shall be deemed to have been done or taken for and on behalf of the Concessionaire and the Concessionaire undertakes to indemnify the Authority for all costs incurred during such period. The Concessionaire hereby leases, licenses licences and sub-leases, sub-licenses licences respectively, the Authority or any other person authorised authorized by it, it under Clause 32.1 to use during Suspension, all Intellectual Property belonging to or licensed licenced to the Concessionaire with respect to the Project and Projectand its design, engineering, construction, operation and maintenance maintenance, and which is used or created orcreated by the Concessionaire in performing its obligations under the Agreement.

The Concessionaire hereby leases, licenses and sub-leases, sub-licenses respectively, the Authority or any other person authorised authorized by it, to use during Suspension, all Intellectual Property belonging to or licensed to the Concessionaire with respect to the Project and its design, engineering, construction, operation and maintenance and which is used or created by the Concessionaire in performing its obligations under the Agreement.

Authority to act on behalf of Concessionaire. 25.6.1 31.2.1. During the period of Suspension, the Authority shall, on behalf of the Concessionaire, collect all Project Revenues operate and maintain the Storage Facility under and in accordance with this Agreement and appropriate the same for meeting the O&M Expenses and for remedying and rectifying the cause of Suspension. Any balance remaining after meeting the aforesaid expenditure shall be deposited in a bank account to be designated by the Concessionaire. For the avoidance of doubt, the Authority shall continue to pay the Fixed Storage Charge, Variable Charges and Bag Handling Charges under and in accordance with this Agreement and deposit the same in the Escrow Accountaforesaid designated bank account after appropriating the expenses and costs specified hereinabove 31.2.2. The Authority shall be entitled to make withdrawals from the Escrow Account for meeting the O&M Expenses and for meeting the costs incurred by it for remedying and rectifying the cause of Suspension. 25.6.2 During the period of Suspension hereunder, all rights and liabilities vested in the Concessionaire in accordance with the provisions of this Agreement shall continue to vest in the Concessionaire, therein and all things done or actions taken, including expenditure incurred by the Authority for discharging the obligations of the Concessionaire under and in accordance with this Agreement and the Project Agreements, shall be deemed to have been done or taken for and on behalf of the Concessionaire and the Concessionaire undertakes to indemnify the Authority for all costs incurred during such period. The Concessionaire hereby leases, licenses licences and sub-leases, sub-licenses licences respectively, the Authority or any other person authorised by it, it under Clause 31.1 to use during Suspension, all Intellectual Property belonging to or licensed to the Concessionaire with respect to the Project Storage Facility and its design, engineering, construction, operation and maintenance maintenance, and which is used or created by the Concessionaire in performing its obligations under the Agreement.

The Concessionaire hereby leases, licenses and sub-leases, sub-licenses respectively, the Authority or any other person authorised authorized by it, it under Clause 26.1 to use during Suspension, all Intellectual Property belonging to or licensed to the Concessionaire with respect to the Project and its design, engineering, construction, operation and maintenance maintenance, and which is used or created by the Concessionaire in performing its obligations under the Agreement.

Authority to act on behalf of Concessionaire. 25.6.1 28.2.1 During the period of Suspension, the Authority shall, on behalf of shall withhold all Tipping Fee payments to the Concessionaire, collect all Project Revenues under and . The Authority shall be entitled to make withdrawals from the Escrow Account for meeting the O&M Expenses and this account for meeting the costs incurred by it for remedying and rectifying the cause of Suspension, and thereafter for defraying the expenses. 25.6.2 28.2.2 During the period of Suspension hereunder, all rights and liabilities vested in the Concessionaire in accordance with the provisions of this Agreement shall continue to vest in the Concessionaire, therein and all things done or actions taken, including expenditure incurred by the Authority for discharging the obligations of the Concessionaire under and in accordance with this Agreement and the Project Agreements, shall be deemed to have been done or taken for and on behalf of the Concessionaire and the Concessionaire undertakes to indemnify the Authority for all costs incurred during such period. The Concessionaire hereby leases, licenses licences and sub-leases, sub-licenses licences respectively, the Authority or any other person authorised by it, it under Clause 28.1 to use during Suspension, all Intellectual Property belonging to or licensed licenced to the Concessionaire with respect to the Project and its design, engineering, construction, operation and maintenance maintenance, and which is used or created by the Concessionaire in performing its obligations under the Agreement.

The Authority shall be entitled to make withdrawals from the Escrow Account for meeting the O&M Expenses and for meeting the costs incurred by it for remedying and rectifying the cause of Suspension, and thereafter for defraying the expenses specified in Clause 31.3. 25.6.2 36.2.2 During the period of Suspension hereunder, all rights and liabilities vested in the Concessionaire in accordance with the provisions of this Agreement shall continue to vest in the Concessionaire, therein and all things done or actions taken, including expenditure incurred by the Authority for discharging the obligations of the Concessionaire under and in accordance with this Agreement and the Project Agreements, shall be deemed to have been done or taken for and on behalf of the Concessionaire and the Concessionaire undertakes to indemnify the Authority for all costs incurred during such period. The Concessionaire hereby leases, licenses licences and sub-leases, sub-licenses licences respectively, the Authority or any other person authorised by it, it under Clause 36.1 to use during Suspension, all Intellectual Property belonging to or licensed licenced to the Concessionaire with respect to the Project Highway and its design, engineering, construction, operation and maintenance maintenance, and which is used or created by the Concessionaire in performing its obligations under the Agreement.
